Non respect de la mission de stage
En quoi cette convention est illicite ? Le fait qu'elle soit rédigée en anglais avec un référentiel à la loi francaise "ACCORDING TO THE FRENCH LEGISLATION: BILL Nº85-1045, 24-09 -85" ou parce qu'elle se doit d'être en français ou encore qu'elle doit faire référence à la loi chilienne sur le travail ?
Comment savoir que qu'un document provient de la traduction ?
Dans le cas où le document n'est issu d'une version officiellement traduite, que risque l'entreprise ?
La mesure du préjudice causée est difficile à juger. Pour ma part, il est d'abord financier (changement de dates en dernière minute : coût de l'avion plus élévé), il est pédagogique (50% de la mission de stage non abordée).

Non respect de la mission de stage
J'ai réalisé mon stage dans une entreprise francaise qui a différents lieux de production dont un au Chili.
La convention est la suivante :

The training mission :
- Support the implementation of visual management in the XXX Chile plant
- Support the value stream mapping initiative related to the on-site activities of the XXX project
ARTICLE 1: Purpose
Work placement is compulsory, to be carried out by any student within the framework of their undertaken studies. It aims at providing the opportunity for the trainee to use and apply the practical knowledge acquired throughout the school course content.
ARTICLE 2: Trainee's statute
Throughout the duration of the placement, the trainee shall remain under the statute of French law as an school student. He or she will be subject to a precise follow-up carried out by the Studies Manager or any school representative according to pre-determined conditions established by school and the company's manager.
ARTICLE 3: General conditions
Throughout the duration of the placement, the trainee shall be subject to the rules and regulations in force in the workplace(s) of the company, in particular regarding planned schedule and safety.
ARTICLE 4: Discipline
Failure to respect these rules and regulations may result in the termination of the trainee's engagement by the Company, after having previously informed the school General Manager. Before the trainee departs, the company shall ensure that school is notified immediately.
ARTICLE 5: Wages
Throughout the placement, the trainee shall not be paid a salary, but may receive a compensation (stipend or incentive bonus) from the company.
ARTICLE 6: Expenses
Housing and living expenses shall be the student's responsibility. If training costs occur during the training period, the company shall pay for them.
ARTICLE 7: Assignment
The company shall communicate its opinion on the trainee's work and behavior. A written certificate shall also be delivered to the student by the company, stipulating the nature and duration of the placement.
ARTICLE 8: Evaluation report
At the end of the placement, the student shall show the evaluation report he has written to the company before giving it to school. A clause of confidentiality may be added by the company.
ARTICLE 9: Social health insurance
The student is covered by the French medical coverage of the French Social Security system during his or her placement.
ARTICLE 10: Accident
Accident, Code de la Sécurité Sociale (French social security law, article L.412-8-2)
In the event of an accident happening to the trainee in the workplace, or during the trainee's journey to or from work, the company commits itself to immediately inform school's General Manager, so as to establish the official declaration to the due services within the legal delay (48 hours). Both the company and the student shall be insured and covered in terms of civil responsibility, according to the current legislation system."
La mission de stafe Visual Management a été réalisé mais pas celle sur le VSM.

Non respect de la mission de stage
Bonjour,
Je souhaiterai obtenir des informations sur le non respect de la mision par une entreprise
J'ai effectué un stage au Chili pendant 3 mois. Sur ma convention j'ai 2 missions de stage.
L'une a été effectué mais la 2eme n'a pas été respecté par l'entreprise.
Quelle est ma marge de manoeuvre ?
